For many years, my biggest aspiration in life was to one day create a game that would inspire people to illustrate fan art, write fan fiction, and wear cosplay. I’m absolutely thrilled to see that a fandom has sprouted up around Yandere Simulator! I’m filled with glee whenever I see fan-made artwork or stories that were inspired by Yandere Sim, and I think that seeing people dress up as Yandere-chan is the coolest thing in the world!
Sometimes, people even imagine new characters for Yandere-chan’s school, or imagine new rivals for Yandere-chan to defeat. I think this is just as cool as all other fan creations! However, there’s something that I should mention: You’re welcome to share your creations with me, but I can’t include any of your original characters in Yandere Simulator. The reason why is a little bit complicated, so I’m going to explain using an anecdote.
Juju
Are you familiar with Skullgirls? It’s my favorite fighting game!
The character named Parasoul commands a group of soldiers, one of whom is a sniper. Shortly after Parasol was announced, a certain gentleman made a post on the Skullgirls Facebook page, stating that Parasoul’s sniper should be named “Juju”, be a Chinese assassin, and have a talking rifle.
As a nod to this gentleman‘s suggestion, the line “Take the shot, Juju!” was added to Skullgirls.
During Skullgirls’ IndieGogo campaign, the developers of the game allowed fans to vote for which characters should become playable in the future. Juju showed up on the poll as a potential playable character.
The gentleman who originally proposed the concept of Juju then made a Facebook post stating that he wished to be compensated for designing a character who was being used in a commercial product. The creators of Skullgirls began negotiating with this gentleman to get the rights to his character. However, it was very difficult for these two parties to reach a mutually satisfactory agreement, and acquiring the rights to Juju turned into a messy legal battle that lasted for several months.
After “continued disruptive and unprofessional conduct” from the gentleman who created Juju, the creators of Lab Zero decided to completely axe the character. “Take the shot, Juju!” was removed from the game, and the character was declared non-canon.
The moral of this story is that if you’re a game developer, and you use a fan-created character in your game without formally acquiring the rights to that character, you’re potentially setting yourself up for a legal nightmare.
If someone wants to design a character for Yandere Simulator, I must require them to sign a copyright transfer agreement which grants me the unlimited and exclusive right to sell, modify, produce derivative works of, display, distribute, or otherwise use their design in any form and by any method, within Yandere Simulator and all directly related media. Anything less than that, and I’m painting a target on my forehead and inviting them to sue me.
In other words, I refuse to let Yandere Simulator get “Juju’d”.
Learning from Juju
If you’ve designed a character for Yandere Simulator, and want to see your character appear in the game, I’m flattered – but I can’t use your design.
It’s possible that, one day, in the future, when I launch the Yandere Simulator crowd-funding campaign, one of the “backer rewards” will be the privilege of designing a student who will appear in the game. The backer will be able to choose the student’s name, personality, and schedule. This may be expensive. If there are extremely few “open character slots”, if it takes a lot of time and effort to implement a new student, and if Yandere Simulator requires a lot of money to be fully funded, then you would have to donate a very significant amount of money to see your character appear in the game.
The bottom line: I’m always delighted to see an original character that someone has designed for fun, but at this point in time, I can’t put your original characters into Yandere Sim. As stated above, I’ve learned important lessons from Juju, and I need to protect myself from those who would seek to take advantage of me.

I bet if you made a pre-made, fill in the blank PDF of a copyright transfer agreement a large number of people would be fine with signing it when they submit stuff to the game (I am a programmer, not a artist, but if I was an artist I would do it)
There’s only one problem; how do I prove the legitimacy of the PDF? If I present it in court, a lawyer could say “Nah, you just opened up the PDF yourself and typed my client’s name in the signature space. There’s no proof that my client ever signed this PDF of their own accord.”
How do I make a PDF legally binding and admissible in a court of law?
Have them physically sign them, scan them, and attach the scan to the submitted work. If they are someone who has taken enough time to learn how to do digital artwork there is a good chance they own a scanner.
If they don’t own a scanner set up a PO box for snail mail submissions (given out only by request of people who do not own a scanner)
Oh, and you also can put a digital signature on the PDF. In the US the “Electronic Signatures in Global and National Commerce Act” (ESIGN, 2000) and the “Uniform Electronic Transactions Act” (UETA, 1999) where put in place. Both ESIGN and UETA establish that electronic records and signatures carry the same weight and legal effect as traditional paper documents and handwritten signatures stating: A document or signature cannot be denied legal effect or enforceability solely because it is in electronic form.

@ YandereDev: Leftler’s suggestions are very good and would improve your chances in court. If you really want an extra layer of protection you need an actual lawyer involved.
Contact me if have an interest in free legal counsel limited to the character rights transfer issue. I can review the documents you want to use to verify they’ll hold up and facilitate the process. Plus, a third party’s involvement makes it harder to challenge. (Never knew you had someone with a law degree checking your site daily, did you?)

I know there is precedent for it but it is not universal, you would have to find out if it is valid where you are, you would need to have a digitally signed document produced and then you would need to keep it in a place you can be sure it won’t be lost or modified (Modding it will invalidate it as it will alter the checksum).
I’m not a lawyer, just an engineer so the best course of action assuming you wanted to do it is hire a lawyer.
All that said I don’t think it is worth the time, effort, and cost, you aren’t Blizzard Entertainment or Valve after all.

Idk were you’re from but it’s really hard to sue someone from abroad so I’ll take that you’re American. Legal processes are long and can take years which can and would be very fiscally draining not only on you but also on the other party. You’re right on trying to set things straight with the copyright stuff but you shouldn’t be bothered too much by it.
As I’m sure you’re aware of, there’s lots of pressure and bullying to perform in a specific way when you’re a public figure (if not nearly as much as a celeb in your case), but it’s usually just that: pressure and bullying. Large companies can and do sue small time developers and people in order to take them out of business but I don’t think it would be likely unless they had some controlled opposition “helping” you with the game.
Also, >getting your character featured in Yandere Simulator is intended to be a reward for donators, and is not something I will do for free.

I totally agree with you about those procedures that have to be done before a fan character will be included into the game.I believe most of them would pay a commission so they can play/see their own character in the game.But the ‘minor’ problem is when they have commissioned the character/hairstyle/etc and it doesn’t get included in the game for some reasons(maybe the no of student already reached out the max,or the character doesn’t really fit with the game,etc) then those people will feel that they paid for nothing.sorry,this just my thought…
I think the main point is ppl SHOULD CONSULT with Yandev FIRST.
Let’s say ppl have their own design,they ask the character modeller,and paid him.next thing they tell Yandev that they already have an original character designed into 3d and wants to include them into the game and ready to sign the legal right but when Yandev sees it,the character doesn’t fit so well (let’s say the original character have far more unique accessories than the rivals,making them more outstanding).then it would be a dilemma coz they already paid them,but including them in the game would make the rival be outclassed.
Or let’s say the original design is an elf(!?) with long ears,they ask the modeller,they pay,they tell Yandev and the same thing happens.he might be thinking ‘I made a game about japanese high school students not fantasy one’.then it would be another dilemma to include or not to include the character.
Maybe this is the solution of your concern..

i think the answer to your question is yes BUT, that only will happen once the kickstart campaign started. Adding original characters to the game will be a reward for the crowdfunding, which he has stated, will probably be around april, next year.
Meanwhile you can commission “hairstyles” to appear in the debug version, like Misato’s hairstyle.
So if lets say, I made an original character and gave you all the rights to that character, would you include my name (Alias) in the credits? because that would be cool and totally motivating.

Getting an original character put in the game for donating money sounds cool, and makes me regret that I can’t draw. I’m not even good at describing appearances of original characters or locations when I’m writing since I want to focus on the story and character development (or at the very least not making them a Mary Sue/Gary Stu) rather than how things look. =( Well, I hope the characters that do end up here are awesome. Keep up the good work on the game.

Joking aside, with less than 100 students and located in Japan, the chances in reality of a black woman in a school with those conditions is very low. I want to murder a black person as much as the next guy but…

Agreeing with you there Dev. No shame in saying no to putting OC’s in. Every time a friend and I had tried to do a project, someone would find a way to try to ruin it. Including giving our character templates away to other people without explaining what they were signing up for, or trying to nail all their friends spots without commenting.
Or using special needs as an excuse to push the need for the character in.
We don’t do things like this anymore. It’s extremely annoying. I had to block one of my fanfict reviewers because she kept making demands of me and sending me nonsense.I had a frank discussion with them about not suggesting things for my works anymore.

What about a poll for hairstyles?
Pick some ideas and ask people to vote, and the most voted get modeled and added to the game.
I like the idea of other people paying to have their hairstyles modeled and added better. That way, there is no limit, and there’s a chance that people could make enough hairstyles to give every character in the game a unique look. (And with over 100 characters planned, imagine how epic that would look.)
People can also use the character as their own if they don’t think they want it in the game/YanDev doesn’t approve.
Everytime there is a “Get your character/yourself in the game” the character turn out to be some kind of furry.
Please don’t do that.

Yes it’s her, she evolved from a fanfiction until her creator took the Duncan route to make her canon. The game developers call her a Mary Sue and makes an OC out of her anyway but in protest.
She is a mary sue deemed OC who got a fanfic, whom her creator forced canon by becoming a top backer, she’s now going to be a double OC as the original game developers makes their own portrayal. The developers hate her for this reason.

This is exactly the reason why I quit some fandoms! Some OCs/Original Characters (okay, most of them were RPCs) where way too overpowered, and were just like:
Oh, she has a sad past and has 5 guys falling for her and she’s friends with everyone and has all the powers in the game/series and blah blah blah.
The thing is that people need to have lots of practice before they can actually make decent characters, sorry to break it to you all. I’ve been making OCs for at least a year now, and mine aren’t as good as some that my friends show me or some that I see online.

I’d rather ask my modeller to model every hairstyle that is available in a popular dress-up game so that anyone who plays the dress-up game can re-create their character in Yandere Simulator.
First I’d like to say, Misato looks really cute and I wish she were able to be a student in the game. Second, to clarify, if we commissioned a model (meaning the rights would belong to us) and we give you permission to use the model (maybe an electronic signature?) You would be able to use the model, correct?
You can have a seeking NPC(Hall monitor, janitor, campus security). That always walk around the school looking for any stange activity.

It will be a long time before the kickstarter, when those OC slots are potentially opened up, so now would be a good time to start saving. If you get 50 a day, you’d have 5000 in about 100 days, which is only about a third of a year. I know you’re a kid without much free money, but it would be good to not take YandereDev too lightly. $100 is actually a really low amount for getting a character in a game, and it might end up more like $500. Wishing you the best, fellow human.
